These terms and conditions define the rules and regulations for the use of Immo France Sud’s online booking site, located at immofrancesud.holidayfuture.com. By accessing this website, we assume you accept these terms and conditions. Do not use Immo France Sud if you do not agree with all the terms and conditions mentioned on this page.

The following terminology applies to these Terms and Conditions, the Privacy Policy, and the Disclaimer, as well as all agreements: "Client," "You," and "Your" refer to the person accessing this website and accepting the terms and conditions of the business. "The Company," "We," "Our," and "Us" refer to our company. "Party," "Parties," or "We" refers to both the Client and ourselves. All terms refer to the offer, acceptance, and payment necessary to begin the process of assisting the Client in the most appropriate manner, expressly to meet the Client's needs in relation to services provided by the Company, in accordance with applicable law.

Application of Sales Terms

These terms and conditions apply only to bookings made through our website immofrancesud.holidayfuture.com. For bookings made via our partner platforms (Airbnb, Booking.com, VRBO, etc.), the specific terms of each platform apply and take precedence over our own terms. In the case of a reservation through these platforms, the client must comply with the cancellation or modification terms set by the respective platform. If the client wishes to obtain information regarding their rental, they may contact us, but any request for cancellation or modification must be addressed directly to the platform.

For reservations made directly by phone or email, we send a rental contract to be signed (electronic signature) along with an identification document. Payment is exclusively by bank transfer. The reservation conditions applicable in this case are those specified in the contract, and they cannot be modified to correspond to those applicable to bookings made on our website.

Booking Conditions

Deposit and Balance

A 30% deposit of the total rental amount is required for any booking made more than 60 days in advance.

The remaining balance will be automatically charged to the credit card used at the time of booking, 60 days before the arrival date. The client must ensure sufficient funds are available at the time of the charge.

In the event of non-payment or an invalid credit card at this deadline, the agency will contact the client through available means (email and/or phone) to regularize the situation as soon as possible.

If no payment is made and no clear communication is received from the client, this will be considered a cancellation by the client. The agency will retain the deposit paid, and the client will not be entitled to any refund.

It is possible to pay the balance by bank transfer upon request. Clients wishing to use this option must contact us to obtain our bank details and payment instructions. Please note that payment by bank transfer does not entitle the client to any special discount.

Security Deposit

A security deposit is required to cover any potential damages during the rental period.

The amount of the deposit depends on the rented property and is specified at the time of booking. It must be paid by bank transfer to the agency's escrow account no later than three weeks before the clients' arrival. A few days before this deadline, we will send them an email with instructions and our banking details to proceed with the transfer.

Please note that, due to technical constraints beyond our control, the client interface on our website displays a default message stating:

"Either charged at the property or by a credit card hold."

This information does not apply to our booking process. The damage deposit is not charged at the property, nor is it held by credit card. It must be transferred to the agency's escrow account as explained above. We will contact you three weeks prior to your arrival to provide all necessary details regarding this payment.

In the event of damages, the cost of repairs carried out by a professional will be deducted from the deposit. If any funds remain, they will be refunded.

A check-in and check-out inspection is carried out by one of our agents in the presence of the client. Proof of repairs (service provider invoices) can be provided upon request.

Cleaning Fees

The cleaning fees are included in the rental and are calculated based on the average time required to clean the house in normal use conditions. In case of excessive dirtiness requiring additional cleaning time, the corresponding cost will be deducted from the security deposit.

Linen Fees

The linen for the property is included in the rental and consists of bed sheets, bath towels for indoor use, and, for properties with a pool, pool towels. The fee is 58€ per person for properties with a pool and 48€ per person for properties without a pool.

Exception: Villas Béatrice, Fontane, BeauVallon and Suberaie include a base linen fee in the nightly price and are therefore not subject to these terms.

Cancellation Policy

In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to seasonal rental contracts. Therefore, any cancellation or modification of a reservation will incur the modification fees described below.

Free Cancellation: Any cancellation made more than 61 days before the departure date will incur no fees.

Partial Cancellation: Any cancellation made between 60 and 31 days before the departure date will incur a fee of 50% of the total rental cost.

No Refund: Any cancellation made within 30 days before the departure date will incur a cancellation fee of 100%. No cancellation will entitle the client to a refund, even if the villa is re-rented.

In exceptional circumstances, we reserve the right to make an exception to this rule after reviewing the circumstances and subject to the property owner’s approval. However, this decision will be made on a case-by-case basis and should not be considered as systematic.

We strongly advise tenants to take out specialized travel insurance if they are not already covered, in order to protect against cancellation fees. Immo France Sud has no partnership with any insurance company and thus has no financial interest in recommending one insurance company over another. Therefore, we do not recommend any specific company, and each traveler is free to choose the insurance provider of their choice.

In the event of a natural disaster, criminal incident, or unforeseen event such as a fire affecting the rental property, the agency will not be held liable for damages or cancellation of the stay. If the client chooses to cancel their trip due to such events, they must refer to the cancellation conditions specified earlier.

Modifications

Name changes do not incur modification fees. If the number of travelers changes, it may incur additional costs, especially concerning bedding adjustments. However, no penalty fees will be applied.

The property occupation charter is available upon request from the agency.

Intellectual Property Rights

Unless otherwise stated, Immo France Sud and/or its licensors own the intellectual property rights to all content on the website. All intellectual property rights are reserved. You may access it for personal use, subject to the restrictions set out in these terms and conditions. In no case may you:

Sell, rent, or sublicense Immo France Sud content,

Reproduce, duplicate, or copy Immo France Sud content,

Redistribute Immo France Sud content.
